Service & Billing Terms

We keep our terms as clear as our marketing promises.

No fine print. No hidden fees. Just the stuff that keeps business running smoothly. We believe in being upfront about how we work, how we bill, and what’s expected on both sides. If anything here sounds too formal, it’s only because lawyers exist.

1. Pricing & Changes

All service pricing is subject to change at any time. Marketing Sux will notify active clients in advance of any rate changes before renewal or billing.

2. Commitment Periods

Digital Advertising (PPC, Social Ads): Minimum 3-month commitment.
SEO Services: Minimum 6-month commitment.
Other Recurring Services: May require custom terms depending on project scope.

3. Cancellation Policy

Cancellation of any service requires a minimum 30-day written notice. All outstanding invoices become immediately due upon cancellation, and any scheduled services within the 30-day notice period will be billed and must be paid in full.

4. Project Payments

All project-based services (e.g., website design, branding, photo/video) require a 50% deposit before work begins, with the remaining 50% due upon substantial completion. “Substantial completion” means the project is functionally complete and ready for client review, regardless of minor revisions, launch delays, or post-project tweaks.

5. Monthly Billing

All monthly retainers or service fees must be paid within the first 15 days of each service cycle. Marketing Sux requires automated or digital payment methods such as credit card, debit card, or ACH transfer.

6. Late Payments

Payments more than 15 days past due may result in a temporary pause of services until payment is received. Payments more than 30 days past due will result in full suspension of all campaigns and projects until the account is brought current. Marketing Sux reserves the right to charge a 2% monthly late fee on overdue balances.

7. Refund Policy

No refunds will be issued for work already performed, time invested, or third-party costs incurred (including ad spend, creative work, or subcontracted services). All deposits are non-refundable once work has begun.

8. Ownership & Access

All creative materials, campaigns, and digital accounts remain the property of Marketing Sux until the final balance is paid in full. Upon full payment, ownership of applicable creative deliverables (websites, designs, videos, etc.) transfers to the client. Ad platform access, analytics accounts, and licensed tools may remain under Marketing Sux management unless otherwise agreed in writing.

9. Ad Spend Management

For digital advertising campaigns, the client is responsible for direct ad-spend costs, billed separately by the advertising platform (e.g., Google, Meta, TikTok). Marketing Sux manages strategy, setup, and optimization but does not assume liability for ad-platform performance, cost fluctuations, or conversion tracking limitations.

10. Results Disclaimer

Marketing Sux makes every reasonable effort to achieve strong performance and ROI. However, due to the unpredictable nature of marketing variables — competition, algorithm updates, budget constraints, and market shifts — no specific results or guarantees are made.

11. Scope Changes

Any additional requests, features, or campaign adjustments outside of the agreed scope will be quoted and billed separately before work begins.

12. Client Responsibilities

Clients agree to provide all required materials, feedback, access credentials, and approvals in a timely manner. Delays, missing information, or lack of communication from the client may impact project timelines, campaign performance, and results. Marketing Sux is not responsible for delays, reduced performance, or missed opportunities caused by late or incomplete client input.

13. Intellectual Property Usage

Marketing Sux reserves the right to display completed work, campaign screenshots, or performance highlights in its portfolio, marketing materials, and case studies unless otherwise requested in writing before the project begins. Confidential client data will never be publicly disclosed.

14. Suspension of Service

If a client fails to make payment within 30 days of the due date, Marketing Sux may pause or terminate all services without notice. Paused services will not automatically resume once payment is made — a reinstatement schedule must be confirmed to restart work.

15. Force Majeure

Marketing Sux is not liable for delays, interruptions, or failures in performance caused by events beyond reasonable control, including but not limited to natural disasters, power outages, internet disruptions, platform outages, strikes, or governmental actions.

16. Agreement Acceptance

By engaging with Marketing Sux, submitting payment, or signing any service proposal, the client acknowledges that they have read and agreed to these terms and conditions.

17. Changes to These Terms

Marketing Sux may update or modify these terms and conditions at any time. Revised versions will be posted on our website with the date of the most recent update. Continued use of our services after a change means you accept the new terms.
